These terms cover using this website and the free mockup builder on it. Paid work is covered by the services agreement you sign, not by this page.

Who we are

Using the site

Use it for what it is for. Do not try to break it, do not try to read somebody else's project, and do not upload anything you do not have the right to upload. If you upload a photo, you are telling us you are allowed to use it.

We may change the site, and we may take it down for a while to work on it.

The free mockup

The mockup builder is free and there is no obligation on either side. You can build one and never speak to us again. We can decline to take on work for any reason.

What you put into it stays yours. Your photos, your videos, your words, your logo. We do not use any of it in our own marketing without asking you first and getting a yes.

A mockup is a preview, not a finished website. Nothing in it is a promise about what a built site would cost or how long it would take, unless we have written that to you.

You can delete your mockup and its files yourself, from the builder, at any time. When you do, the private preview link stops working.

Mockups we make for a business that did not ask

Sometimes we build a concept for a local business to show what we would do. When we do that:

• The page says, at the top and before anything else, that it was made by Ember

Media, that it is not affiliated with the business and that it is not their real site.

• It lives at a private link that is not listed anywhere and is not indexed by

search engines.

• It carries only what a public listing shows. No invented review, no invented

price, no invented opening time.

• If the business asks us to take it down, we take it down. No argument and no

conditions.

Paid work

When you hire us, the services agreement you sign is the contract. It covers what we are building, what it costs, what happens if either of us wants to stop, and who owns what at the end. Where that agreement and this page disagree, the agreement wins.

What we do not promise

We build websites and we run advertising when a client asks us to. We do not promise a ranking, a number of leads, a number of bookings or an amount of revenue. Anybody in this trade who does is guessing. Where we show an estimate, it is labelled as an estimate and shown as a range.

Booking pages

A client's booking page collects their customers' details on their behalf. The client is responsible for how they use those details. We hold them for the client and we do not use them for anything else.

Our own material

The design, the code and the words on this site are ours. The work we build for a client is covered by their agreement, which says what transfers to them and when.

Liability

To the extent the law allows, we are not liable for lost profits, lost business, or anything indirect that follows from using this site or the free mockup. Nothing here limits anything that cannot be limited by law.

Which law

Louisiana law, and the courts of Jefferson Parish, Louisiana.

Changes

If we change these terms we will change the date at the top.
